1. Description of Services

Bavari Tours acts as an aggregator and intermediary for third-party tourism services, specializing in multi-day tours in the Dominican Republic. Our services include facilitating bookings for tours, transportation, and accommodation on behalf of local tour operators.

No Direct Operation of Services: Bavari Tours does not operate the tours, transportation, or accommodation services directly. Therefore, we are not responsible for the quality, safety, or execution of these services.

Third-Party Responsibility: All responsibility for the execution, guarantees, and compliance with the terms of the services lies with the respective operator or provider.

2. Acceptance of Reservations and Site Usage

  • Age Requirement: By making a reservation, you confirm that you are at least 18 years old and have the legal capacity to accept these terms.
  • Accuracy of Information: You agree to provide accurate, truthful, and complete information when creating an account or making a reservation.
  • Account Responsibility: You are responsible for maintaining the confidentiality of your account and password. Any activity conducted under your account is your responsibility.

3. Responsibility of Bavari Tours

  • Intermediary Role: Bavari Tours serves solely as an intermediary between the client and the service operator. We facilitate the booking process and provide support but do not control or oversee the actual service execution.
  • Customer Support: We offer customer support to assist with booking management and address any queries before the tour begins.
  • Disclaimer of Liability: We are not liable for any incidents, losses, damages, or inconveniences that may arise from the use of third-party services. Responsibility for such events lies entirely with the service provider.

4. Booking and Payment Conditions

  • Booking Confirmation: All reservations are subject to availability and operator confirmation. Once confirmed, you will receive an email with booking details.
  • Payment Methods: We accept secure online payments through third-party processors like PayPal. Bavari Tours does not store or retain payment details.
  • Price Policy: Tour and service prices are set by operators and may change. Prices are only guaranteed upon reservation confirmation is in status ‘Completed‘.
  • Currency: All our tours and services are priced in United State Dollars, USD.

5. Modification and Cancellation of Reservations

  • Cancellation Policy: The cancellation and refund policy is determined by our Cancellation Policy and will be communicated during booking. It is your responsibility to review and agree to this s policy.
  • Changes to Reservations: For any changes to confirmed reservations, contact us. While we will strive to assist you, modifications are subject to availability and operator policies.

6. User Responsibilities

By booking a tour or service through Bavari Tours, you agree to:

  • Comply with Operator Policies: Each operator has their own terms, including schedules, safety requirements, and transport conditions. You are responsible for adhering to these terms.
  • Provide Accurate Information: Ensure all booking details are correct. Inaccurate information may lead to cancellation or inability to access the service.
  • Maintain Appropriate Conduct: Users are expected to behave respectfully during tours and services. Operators reserve the right to deny service in cases of inappropriate behavior.

7. Exclusion of Warranties and Limitation of Liability

  • Guarantees: Services are provided by operators “on behalf of Bavari Tours customers.” While Bavari Tours does not directly operate or manage the activities, accommodations, or transportation services offered by third-party operators, we are deeply committed to our clients. Our role as an aggregator means that we facilitate the booking process, but do not have direct control over the execution of these services. However, we will use all available means to ensure that the guarantees and privileges offered by the operators are upheld and respected.
  • Limitation of Liability: As an intermediary, Bavari Tours cannot be held directly liable for incidents, quality issues, or non-fulfillment of services provided by third-party operators. However, under no circumstances does this absolve us of our commitment to our clients. While our liability is limited to the scope of booking facilitation, we will actively work to mediate and resolve any disputes, ensuring that your rights as a customer are protected. Our team is dedicated to supporting you in addressing issues with the responsible operator and advocating for the fulfillment of the agreed-upon services.

8. Intellectual Property

All intellectual property rights for content on our platform, including text, graphics, logos, and software, are owned by Bavari Tours or its licensors. Any reproduction, distribution, or modification of content without explicit written consent is prohibited.

All promotional material for destinations, hotels, attractions, theme parks, and other activities is the property of the respective service providers. Such materials are used solely for promotional purposes of those services, and under no circumstances shall Bavari Tours be held legally responsible for the content displayed for these purposes.

9. Privacy and Data Protection

We respect your privacy and handle your personal information in accordance with our Privacy Policy. By using our services, you agree to the use of your information as outlined in this policy.

10. Modifications to Terms and Conditions

We reserve the right to modify these Terms and Conditions at any time. Any changes will be published on our platform. Continued use of our services after changes are published constitutes acceptance of the updated terms.

11. Governing Law and Jurisdiction

These Terms and Conditions are governed by the laws of the Dominican Republic. Any disputes related to the use of our services will be subject to the jurisdiction of the courts in the Dominican Republic.

  • Excluded Services: The support team is not responsible for addressing inquiries unrelated to the booked tour, such as:
    • Travel arrangements (e.g., flights or transport not provided by Bavari Tours).
    • Personal matters or guarantees unrelated to the tour.

    • After-Hours Policy: Support outside these hours, including nights, weekends, or holidays, is not guaranteed and is subject to availability.

    • Reasonable Efforts: Bavari Tours will make all reasonable efforts to resolve client issues related to the booked tour. However, there is no obligation to provide solutions that fall outside our operational scope or resources.
    • Timeliness: While we strive to respond promptly, delays may occur during peak periods or unforeseen circumstances.
    • Force Majeure: Support may be limited during events beyond our control, such as natural disasters or technical outages.
